These Terms of Service (the “Terms”) govern your access to and use of the Donate 3Dgifts website located at donate3dgifts.com and any related services (collectively, the “Service”). By accessing or using the Service you agree to be bound by these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You may purchase 3D animation gifts (“Gifts”) using your payment card. Each Gift triggers a short animation and accompanying sound effect on the streamer’s live broadcast. Your public nickname, donation amount and message will be displayed to the creator and their audience.
By integrating the Service with your stream you authorize us to display purchased Gifts in real-time. You are solely responsible for moderating the messages and ensuring your use of Gifts complies with the policies of the streaming platform (e.g., Twitch, YouTube, Trovo). We are independent and not endorsed by those platforms.
You may not upload, transmit or display content that is illegal, hateful, sexually explicit, harassing, or infringes any intellectual-property right. We may remove or block any content at our discretion.
The Service, including all templates, animations, trademarks and software, is owned by Donate 3Dgifts or its licensors and is protected by applicable copyright and trademark laws. Subject to these Terms, we grant you a limited, non-exclusive and revocable license to use the Service.
You retain ownership of content you submit (messages, usernames, custom animations). By submitting content you grant us a worldwide, non-exclusive, royalty-free license to host, display and transmit such content for the purpose of providing the Service.
If you believe content on the Service infringes your copyright, please send a written notice to support@donate3dgifts.com containing the information required by the Digital Millennium Copyright Act (17 U.S.C. §512).
You agree not to: (a) reverse engineer or modify the Service; (b) use the Service for fraudulent or illegal purposes; (c) attempt to gain unauthorized access to other accounts; (d) interfere with the availability of the Service.
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure or error-free.
To the maximum extent permitted by law, Donate 3Dgifts and its affiliates shall not be liable for any indirect, incidental or consequential damages arising out of or in connection with the Service, including loss of profits or data, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless Donate 3Dgifts, its directors and employees from any claims, damages, liabilities and expenses arising from your use of the Service or violation of these Terms.
We may suspend or terminate your account at any time for violation of these Terms or for any reason. You may delete your account at any time via your profile settings or by emailing us.
These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict of law principles. Any dispute shall be resolved in the Harju County Court (Tallinn), unless you and we agree to alternative dispute resolution such as arbitration or online mediation.
We may update these Terms at any time by posting the revised version on this page and updating the “Effective date” above. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
